PhRMA, PSM and CAHC File an Importation Citizens Petition

Covington and Burling LLP, on behalf of the Pharmaceutical Research and Manufacturers of America (PhRMA); Ballard Spahr LLP, on behalf of the Partnership for Safe Medicines (PSM); and Sidley Austin LLP, on behalf of the Council for Affordable Health Coverage (CAHC), have submitted a Citizens Petition regarding New Mexico’s application for approval of a state importation plan to FDA. The petitioners assert that New Mexico’s plan is “so short on detail that FDA cannot assess whether the safety or cost criteria can be met.” The petitioners requested that FDA refrain from authorizing New Mexico’s importation application and take other measures.
