MT: Box Elder Man Arraigned on Fentanyl Distribution Charges

A Box Elder man was arraigned in U.S. District Court in Great Falls last week on allegations of distributing fentanyl.

Larry Albert Bernard, 37, pleaded not guilty to the charges of conspiracy to possess with intent to distribute controlled substances, possession with intent to distribute controlled substances and maintaining drug-involved premises.

The Grand Jury indictment alleges that from August through at least December of 2020, Bernard possessed and intended to distribute fentanyl and fluorofentanyl in Hill County and on the Rocky Boy’s Reservation. In addition, Bernard is alleged to have used his Box Elder residence for the purposes of distributing and using those controlled substances.

Fluorofentanyl is a synthetic opioid similar to fentanyl, and can be stronger in some cases.

If convicted of the most serious crime, Bernard faces a maximum of 20 years in prison, a $1 million fine and three years of supervised release.

Bernard was released pending further proceedings and has had a public defender appointed on his behalf.

A plea agreement is due by August 3rd, otherwise the case is set for a jury trial that would begin on August 17th.

The FBI and Tri Agency Task Force investigated the case.
