FL: Florida woman faces over 260 prescription drug fraud charges

Kelly A. Gaffney, 49, was a medical assistant for a doctor in Bradenton and had been submitting fraudulent prescriptions at a pharmacy in Sarasota.

BRADENTON, Fla. – A Florida woman has been arrested and faces 241 felony charges and 26 misdemeanor charges related to trafficking controlled substances, criminal use of personal identification, and possession of prescription blanks.

Kelly A. Gaffney, 49, was a medical assistant for a doctor in Bradenton and had been submitting fraudulent prescriptions at a pharmacy in Sarasota.

The faux prescriptions were from Gaffney’s employer, but she wasn’t a patient at her office.

The doctor that Gaffney worked for looked at her prescribing profile after realizing that some prescriptions may have been stolen. Once the doctor realized that Gaffney was to blame, they called Sarasota Police to report the crime.

Detectives determined that Gaffney was stealing blank prescription slips from her work starting in April 2018. She was stealing prescription forms for her and her son on a monthly basis.

Video surveillance from a Sarasota pharmacy showed Gaffney using the forms she stole from her employer to fill a prescription and later paying for the drugs.

In two years, Gaffney was able to get 2,760 Morphine pills, 5,160 Oxycodone pills, and 1,530 Lorazepam pills.

On April 13, Gaffney was arrested by undercover Sarasota Police Detectives at the pharmacy in Sarasota for multiple counts of trafficking Oxycodone and Morphine and for obtaining a controlled substance by fraud.

On April 28, more charges were added to Gaffney’s total:

116 counts of Obtaining or Attempting to Obtain by Fraud
116 counts of Criminal Use of Personal Identification Information
26 counts of Possession of RX Prescription Blanks (misdemeanors)
3 counts of Trafficking in Morphine 4-14 grams
3 counts of Trafficking in Oxycodone 7-14 grams
3 counts of Possession of a Controlled Substance (Lorazepam)

Gaffney is being held at the Sarasota County Jail on a $360,000 bond.
